TERMS AND CONDITIONS

    impronta.com (hereinafter the "Site") is owned by Bi&Do Srl, but managed entirely by Logical System Srl with headquarters in Jesi (An), Via dell'Industria 50, registered with the Chamber of Commerce of Ancona, tax code no. 00881800429, VAT no. 00881800429 (hereinafter "The Company").

    When the Customer places a purchase order through the Site, the related sales contract between the Customer and the Site will be administered in accordance with these Terms and Conditions, and specifically in accordance with the Terms of Purchase mentioned below.

    Terms of purchase
    Before ordering any Products online from the Site, please read these Terms of Purchase carefully.

    Application of the Terms of Purchase
    These Terms of Purchase apply to all offers and contracts relating to the sale and delivery of Products. In other words, the Customer agrees to comply with these Terms of Purchase when (i) ordering one or more Products from the Company Site or (ii) from any other web page linked to our Site (collectively "Site"), or when accepting an offer received from the Site. Deviations from these Terms of Purchase may only be made with the written consent of the Company.

    Requirements needed to conclude a contract
    To purchase Products through our Site you must be at least 16 years of age.
    Orders through our Site are permitted only to consumers, and not to resellers.
    It is the Customer's responsibility to ensure that the information provided to the Company when making an enquiry or ordering is accurate and complete.

    PRODUCTS

    The company sells on its website products belonging to its respective brands.

    Variations in color or other entities are possible in the Products due to the use of different technologies for the acquisition and reproduction of images. The company is not responsible for such variations and deviations.

    PRICES

    The prices shown are in Euro (EUR) and include VAT.

    The company reserves the right to make changes to the price and the Product before the Customer has placed his order.
    The Company reserves the right to change, limit or end any special offer or discount on the Products at any time.

    The company applies fees for the delivery of the Products. Shipping is free in Italy for net orders over €79.00.

    For Italy and EU countries, shipping costs, if any, will be highlighted in the cart, added to the order amount and paid at checkout. For non-EU countries, the costs indicated on the payment page include the costs of the product(s) and shipping. Where applicable, customs duties and taxes of the destination countries are not included and must be paid by the Customer.

    ORDERS

    The information contained in the Site does not constitute an economic offer or a binding agreement. The Customer agrees that his order is an offer to purchase the Products listed in the order itself.

    The Company has the right, at any time, to verify an order in advance and/or to refuse an order without obligation to provide explanation. If the Company does not confirm the order within ten working days, the order may be considered refused.
    All purchase orders submitted by the Customer are subject to acceptance by Logical System. The Company reserves the right not to accept an order at its sole discretion.

    Here are some examples of circumstances where an order may not be accepted:

    • The Products, although shown on the Site, are not available;
    • The Company is unable to obtain payment authorization from the Customer;
    • A Product is subject to certain shipping limits;
    • A Product displayed on the Site contains an obvious error, for example an incorrect price or an otherwise incorrect description.

    Once the order has been placed, the Customer will receive an e-mail from the Company containing the order number and the data of the Products ordered. The acceptance of the order and the formulation of the sales contract between the Company and the Customer will not actually take place until the Customer has received an e-mail from the Company confirming the shipment.

    If the order (or part of the order) is cancelled, the amount will of course be refunded to the Customer using the same method used for payment. Refunds are usually made within 1 or 2 working days of the returned and approved goods being received. However, it may take a few more days for the Customer's bank to process the transaction.

    The Products will remain the property of the Company until the Customer has paid the full amount due under the agreement.

    Cancelling orders
    Unfortunately, it is not possible to cancel or change the order, even if it has not yet been shipped, as the order is processed from the moment it is received. It will still be possible to return the goods and receive a refund. It is possible to obtain a refund on returned Products only if the return is made in compliance with our criteria (see Returns and refunds section).

    Exchange of goods
    The company does not exchange goods. If you wish to exchange a Product, you must first return the purchase and then place a new order. You can obtain a refund on returned Products only if the return is made in compliance with our criteria (see Returns and Refunds section).

    Changing the delivery address
    The delivery address cannot be changed after the order has been submitted.
    The delivery address can be changed before a new purchase through the dedicated account page.

    PAYMENTS

    Before completing the purchase, check the delivery address indicated and then choose the payment method. Then proceed to the order by clicking on "Confirm order". After confirmation it will no longer be possible to modify the order, so before clicking on the Confirm button check that the information is correct.

    Logical System Srl accepts only advance payment for products ordered via Credit/Debit Card, Paypal. Credit/Debit Card data and PayPal data are managed via SSL certified encrypted protocol which guarantees the security of the online transaction. Payment for orders placed on the site is managed directly by Paypal and the banks in charge which, through their protected servers, directly manage the information relating to each order and its payment. The company does not become aware of the credit/debit card data and is therefore not able to archive or store them in any way.

    BILLING

    The company will send a regular receipt to the Customer, in paper format, together with the purchased goods. However, the company reserves the right to send or make available the invoice in electronic format and the Customer agrees to receive the invoice in this format.

    SHIPPING

    The company will deliver the goods to the address indicated by the Customer only at homes or offices. Shipments are made exclusively to the country of registration of the customer, shipments to other countries other than the country of registration are not accepted.
    Shipments are made during working days, excluding midweek holidays in the country of delivery. The Customer must therefore consider holidays the holidays in force in his/her country, region and municipality of residence in addition to the holidays in force in the city of Rovigo, Italy (location of the logistics warehouse). Note: holidays may vary from country to country and from one year to another. We suggest checking the Holidays calendar to be able to formulate a forecast of the delivery periods).

    The ordered Products will be shipped within 5 working days from receipt of payment. Shipments will be delivered within 2/5 working days.
    Delivery periods are indicative and do not represent binding deadlines. The mere extension of delivery times does not entitle the Customer to any compensation.

    The company reserves the right to make partial deliveries so that the customer receives the ordered goods as soon as possible.
    In the unlikely event that The Company discovers, after the closing of the sales contract, that it is no longer possible to deliver the Products ordered for reasons beyond its control, it will have the right to cancel the agreement. Obviously The Company will inform the Customer promptly, refunding the payment made.

    Delivery rates vary depending on the destination country.

    Shipping is free in Italy for net orders over €79.00. For net orders under €79.00 the shipping cost is €6.00. Shipping is free in all foreign countries (EU and non-EU) for net orders over €159.00. For net orders under €159.00 the shipping cost is €15.00.

    For Italy and EU countries, shipping costs, if any, will be highlighted in the cart, added to the order amount and paid at checkout. For non-EU countries, the costs indicated on the payment page include the costs of the product(s) and shipping. They do not include, where applicable, customs duties and taxes of the destination countries, which must be paid by the Customer. We cannot predict how much to pay for taxes and duties, so we invite the customer to check them before placing an order. In the event of refusal of the goods by the customer or failure to deliver for other reasons (e.g. incorrect address and/or telephone number of the recipient; repeated absence of the recipient, etc.), the amount will be retained to cover the following expenses: sending the goods + returning the goods + customs for return and charged to the recipient. The price of the goods for the difference will be refunded instead.

    Once the order has been picked up by our courier, the Customer will receive an email containing the order details and the tracking number to monitor his shipment in real time. It is always possible to access an archive of orders in the CUSTOMER AREA and, through this, it is possible to see all the information relating to your purchases.
    The company is responsible for shipping the order until it is delivered, at which point the responsibility passes to the Customer who receives it or to the person who signs the receipt of the package, who becomes responsible for it. The company's responsibility for the shipment ends at the moment of signature.

    RETURNS AND REFUNDS

    Pursuant to art. 52 of Legislative Decree 206/2005, the Customer has the right to withdraw from the agreement in the event of a change of heart by completing and sending the appropriate form by email to shop@synergical.it. DOWNLOAD FORM. In other words, the Customer has the right to return the Products in the manner listed below, and the company will guarantee the Customer a refund of the purchase.

    The Customer is allowed to return the Products received within 15 days of delivery without having to provide a reason.
    If the return occurs outside the aforementioned period or if the item shows signs of wear/damage or is not returned in the original packaging and/or with the specific protections, the company will not accept the return and will not make any refund. The return of the Products is accepted only in the presence of the original tag.

    Returns are the customer's responsibility and must be agreed upon by contacting Customer Service at shop@synergical.it. The company assumes no responsibility for shipments lost or sent to the wrong addresses.

    The Products, as reasonably as possible inserted in their original packaging, must therefore be returned to:

    The duration of the transit of the returned goods is not under the control of Logical System, but as soon as we receive the return, we will process the refund as quickly as possible, if the return conditions have been respected. The return will be processed within a minimum of 5 days. In the event of a valid return based on these Terms of Purchase, the company will refund the shipping costs (in the case of orders returned in full) and the price of the returned goods, within 1 or 2 working days of receiving the Product. It is understood, however, that the obligation to refund arises for the company only after receipt of the returned Products.
    The company will refund within 1 or 2 working days from the acceptance of the return, however the bank or the issuer of the Customer's credit card may take longer to credit the refund. The status of the return of the goods and refund of the payment can be verified through the user page of the Site. The company will refund the total value of the Products using the same method with which the purchase was made.
    In the event of a Product being returned that is damaged due to omissions or improper use caused by the Customer, or at the Customer's expense and risk, the Company reserves the right to deduct from the refund due to the customer the amount necessary to repair the damage. It is possible to avoid the obligation to compensate for the decrease in value of the Product caused by improper use by using the Product in its proper way, and avoiding to the extent possible any action that may negatively affect its value.

    Instructions for returning Products in Italy and foreign countries (EU and non-EU)

    • Please make sure to ship the item in its original packaging, including the original label/tag and protectors;
    • Use the return shipping label provided by the carrier;
    • If necessary, contact Customer Service at +39β€Ž 351 212 1407 (Mon-Fri 9:00 - 13:00 and 14:00 - 17:00 Italian time - GMT+1) or at shop@synergical.it.

    WARRANTY

    All illustrations and representations available on the Site or communicated by us must be understood as having a mere illustrative title of the Products, and do not in any way represent our declaration of conformity of the Products to the same.

    In the event of a lack of conformity of the purchased Product, the Customer will have the right to restore, free of charge, the conformity of the Product by repairing or replacing the Product itself or, alternatively, to an appropriate reduction in price or to the termination of the contract.

    It is specified that a lack of conformity exists when one of the following situations occurs: (i) the product is not suitable for the use for which it is normally intended; (ii) it does not conform to the description or does not possess the qualities promised by the seller; (iii) it does not offer the qualities and performances usual for a good of the same type; (iv) it is not suitable for the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller.

    In the event of a lack of conformity, the Customer may request, at his/her choice:

    • the repair of the Product or its replacement, unless the requested remedy is objectively impossible or excessively onerous compared to the other. In particular, a remedy is to be considered excessively onerous if it imposes unreasonable costs compared to the other, taking into account: (i) the value that the good would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be implemented without significant inconvenience for the Customer.
    • Alternatively, you may request, at your discretion, an appropriate reduction in price or termination of the contract, if one of the following situations occurs: (i) repair or replacement is impossible or excessively expensive; (ii) the Product has not been repaired or replaced within a reasonable time; (iii) the replacement or repair previously carried out has caused significant inconvenience to the Customer.

    A minor lack of conformity for which it has not been possible or is excessively onerous to pursue the remedies of repair or replacement does not give the right to terminate the contract.

    The right to the legal guarantee of conformity will be exercisable exclusively within the term of two (2) years from the delivery of the Product, provided that the relevant request for repair or replacement of the defective Product or Products is sent within two (2) months from the discovery of the defect. To this end, the Customer must keep the purchase receipt and the delivery receipt of the Product, which must be attached to the request for repair or replacement under warranty. In the absence of a delivery receipt of the Product, the term of two (2) years mentioned above will be calculated from the day of purchase of the Product.

    The Customer shall be entitled to repair, replacement, price reduction or termination of the contract in relation to any Product or any component identified as defective, unless otherwise provided and in accordance with Applicable Law:

    The company has the right to view the Product and, before proceeding with the application of the guarantee, verify that it is actually a lack of conformity.

    The guarantee cannot be applied if

    • The Products have been repaired or altered by persons other than Bi&Do Srl or Logical System, or by any other authorised person; and/or
    • The lack of conformity of the Product or Products has manifested itself after the term of two (2) years from the delivery of the Product itself and/or the relative request for repair or replacement of the defective Product or Products has been sent after two (2) months from the discovery of the defect; and/or
    • The defects are due (in whole or in part) to misuse, improper use or storage or maintenance or installation performed by persons other than Bi&Do Srl, or by any other authorised person - or failure to comply with the instructions provided by the Company together with the Products delivered.

    APPLICABLE LAW AND JURISDICTION

    These Terms and Conditions are governed by Italian law.
    Sales contracts are governed by Italian law, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
    The User and the company may therefore decide to resolve disputes in 3 ways

    Competent court: For civil disputes, the mandatory territorial jurisdiction is that of the judge of the place of residence or domicile of the consumer, if located within the territory of the State.

    ODR: In the event of a dispute, the user may submit a complaint via the European Union ODR platform, which can be reached at the following link http://ec.europa.eu/consumers/odr/. The ODR platform is an access point for users who wish to resolve disputes arising from online sales or service contracts out of court.     ADR: The Procedure can be started if the consumer, after having submitted a complaint to the company, within 45 days, has not received a response or has received a response that he does not consider satisfactory.
